Filing a Copyright Infringement Notice
If you believe your copyrighted work has been used on rvsns in a way that constitutes infringement, send a written notice to our Designated Agent (above) that includes all of the following:
- A physical or electronic signature of the copyright owner, or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed (or, for multiple works, a representative list).
- Identification of the material that is claimed to be infringing, with information reasonably sufficient to permit us to locate it (e.g., the order ID or the date and email used at upload).
- Your contact information — full name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
Important: Knowingly making a material misrepresentation in a DMCA notice may result in liability for damages under 17 U.S.C. § 512(f). If you are unsure whether the material is infringing, consider consulting an attorney before filing.
Our Response
Upon receipt of a complete and valid notice, rvsns will (i) promptly remove or disable access to the allegedly infringing material; (ii) notify the user who uploaded the material; and (iii) take reasonable steps to forward the notice to that user. Because uploaded files are automatically deleted from our servers within 48 hours of upload (per our retention policy in the Terms of Service), most material identified in a notice will already be unavailable by the time we review the notice.
Counter-Notification
If material you uploaded was removed in response to a DMCA notice and you believe the removal was a mistake or misidentification, you may file a counter-notification with our Designated Agent. The counter-notification must include all of the following:
- Your physical or electronic signature.
- Identification of the material that was removed and the location at which it appeared before it was removed.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your full name, mailing address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the federal court in the judicial district where your address is located (or, if outside the U.S., any judicial district in which rvsns may be found), and that you will accept service of process from the person who provided the original notice or their agent.
Once we receive a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action seeking an injunction within 10–14 business days, we may restore the material at our discretion.
Repeat Infringer Policy
In accordance with 17 U.S.C. § 512(i), rvsns has adopted and reasonably implements a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. We reserve the right to terminate any account immediately, without notice, if we determine in our sole discretion that a user has violated copyright law or these policies on more than one occasion.
